(the "Seller")

2. These Terms govern the mutual rights and obligations of the Seller and a natural person who concludes a purchase contract outside their business activity as a consumer, or within their business activity (the "Buyer"), through the web interface of the REFIT online store (www.refitshop.eu and its country versions) (the "Online Store").

3. The provisions of these Terms form an integral part of the purchase contract. Any terms agreed in the purchase contract that differ from these Terms take precedence.

4. These Terms and the purchase contract are concluded in the English language.

II.

Information about goods and prices

1. Information about the goods, including prices and their main characteristics, is given for each product in the catalogue of the Online Store. Prices include value added tax and all related fees. Prices remain valid for as long as they are displayed in the Online Store. This provision does not exclude concluding a purchase contract under individually agreed conditions.

2. The presentation of goods in the catalogue of the Online Store is for information purposes only and the Seller is not obliged to conclude a purchase contract regarding these goods.

3. Information on packaging and delivery costs is published in the Online Store and applies to the delivery countries offered there.

4. Discounts on the purchase price cannot be combined unless the Seller and the Buyer agree otherwise.

III.

Order and conclusion of the purchase contract

1. Costs incurred by the Buyer when using means of distance communication in connection with concluding the purchase contract (internet connection, phone calls) are borne by the Buyer. These costs do not differ from the basic rate.

2. The Buyer places an order:

  • through their customer account, if they have registered in the Online Store,
  • by completing the order form without registration.

3. When placing the order, the Buyer chooses the goods, quantity, payment method and delivery method.

4. Before sending the order, the Buyer can check and change the data entered. The Buyer sends the order to the Seller by clicking the order button. The data stated in the order are considered correct by the Seller. The order is valid only if all mandatory fields of the order form are completed and the Buyer confirms that they have read these Terms.

5. Immediately after receiving the order, the Seller sends the Buyer an order confirmation to their e-mail address. The purchase contract is concluded at the moment this confirmation is delivered to the Buyer.

6. If the Seller cannot meet any of the requirements stated in the order, it will send the Buyer an amended offer by e-mail. The amended offer is considered a new proposal of the purchase contract, and the contract is concluded when the Buyer confirms acceptance of this offer to the Seller's e-mail address stated in these Terms.

7. All orders accepted by the Seller are binding. The Buyer may cancel the order until the Seller's acceptance of the order is delivered to the Buyer. The Buyer may cancel the order by phone or e-mail using the Seller's contact details stated in these Terms.

8. In the event of an obvious technical error on the Seller's side in stating the price of goods in the Online Store or during ordering, the Seller is not obliged to deliver the goods at this obviously incorrect price, even if the Buyer has received an automatic order confirmation. The Seller will inform the Buyer of the error without undue delay and send an amended offer by e-mail. The amended offer is considered a new proposal of the purchase contract, and the contract is concluded when the Buyer confirms acceptance to the Seller's e-mail address.

IV.

Customer account

1. After registering in the Online Store, the Buyer can access their customer account and order goods from it. The Buyer can also order goods without registration.

2. When registering and ordering, the Buyer must provide all data correctly and truthfully and update them whenever they change. The data provided by the Buyer are considered correct by the Seller.

3. Access to the customer account is secured by a user name and password. The Buyer must keep the access information confidential. The Seller is not liable for any misuse of the customer account by third parties.

4. The Buyer may not allow third parties to use the customer account.

5. The Seller may cancel the customer account, in particular if the Buyer has not used it for a long time or if the Buyer breaches their obligations under the purchase contract or these Terms.

6. The Buyer acknowledges that the customer account may not be available continuously, in particular due to necessary maintenance of the Seller's or third parties' hardware and software.

V.

Payment terms and delivery of goods

1. The Buyer may pay the price of the goods and any delivery costs:

  • online by payment card through the Shopify Payments payment gateway,
  • via Apple Pay and Google Pay,
  • via Klarna,
  • via PayPal, if this method is offered at checkout.

2. Together with the purchase price, the Buyer must pay the Seller the agreed packaging and delivery costs. Unless expressly stated otherwise, the purchase price also includes the delivery costs.

3. The purchase price is payable when the order is placed.

4. When paying through a payment gateway, the Buyer follows the instructions of the relevant payment provider.

5. The Seller does not require any advance payment from the Buyer. Payment of the purchase price before dispatch is not an advance payment.

6. The goods are delivered to the Buyer:

  • to the address specified by the Buyer in the order,
  • to the pick-up point specified by the Buyer.

7. The delivery method is chosen during ordering.

8. Delivery costs depending on the method of dispatch and receipt are stated in the Buyer's order and in the Seller's order confirmation. If a delivery method is agreed at the Buyer's special request, the Buyer bears the risk and any additional costs of this delivery method.

9. If the Seller is obliged to deliver the goods to the place specified by the Buyer, the Buyer must accept the goods upon delivery. If, for reasons on the Buyer's side, the goods have to be delivered repeatedly or in a different way than stated in the order, the Buyer must pay the costs of repeated or different delivery.

10. When taking over the goods from the carrier, the Buyer must check that the packaging is intact and report any defects to the carrier immediately. If the packaging shows signs of unauthorised opening, the Buyer does not have to accept the parcel.

11. The Seller issues the Buyer a tax document (invoice) and sends it to the Buyer's e-mail address.

12. The Buyer acquires ownership of the goods by paying the full purchase price including delivery costs, but not before taking over the goods.

13. The risk of accidental destruction, damage or loss of the goods passes to the Buyer when the goods are taken over or when the Buyer was obliged to take them over but failed to do so in breach of the purchase contract.

VI.

Withdrawal from the contract

1. A Buyer who concluded the purchase contract outside their business activity as a consumer has the right to withdraw from the contract.

2. The withdrawal period is 14 days

  • from the day the goods were taken over,
  • from the day the last delivery was taken over, if the contract covers several types of goods or delivery in several parts,
  • from the day the first delivery was taken over, if the contract covers regular repeated delivery of goods.

3. Among other cases, the Buyer cannot withdraw from a purchase contract

  • for goods that were modified according to the Buyer's wishes or for the Buyer personally,
  • for perishable goods and goods that were irreversibly mixed with other goods after delivery,
  • for goods in a sealed package which the Buyer has removed from the package and which cannot be returned for hygiene reasons,
  • in other cases listed in Section 1837 of the Civil Code.

4. To meet the withdrawal period, the Buyer must send the withdrawal statement within the withdrawal period.

5. The Buyer may use the model withdrawal form provided by the Seller. The Buyer sends the withdrawal to the Seller's e-mail or postal address stated in these Terms. The Seller will confirm receipt without delay.

6. A Buyer who has withdrawn from the contract must return the goods to the Seller within 14 days of the withdrawal. The Buyer bears the costs of returning the goods, even if the goods cannot be returned by regular post due to their nature.

7. If the Buyer withdraws from the contract, the Seller will refund all money received, including delivery costs, without delay and no later than 14 days after the withdrawal, using the same payment method. The Seller will refund in another way only if the Buyer agrees and it causes no additional costs to the Buyer.

8. If the Buyer chose a delivery method other than the cheapest one offered by the Seller, the Seller will refund delivery costs only up to the amount of the cheapest delivery method offered.

9. If the Buyer withdraws from the purchase contract, the Seller is not obliged to refund the money before the Buyer hands over the goods or proves that they have sent them.

10. The Buyer must return the goods complete and undamaged. The Buyer is only liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. The Seller is entitled to set off a claim for damage to the goods against the Buyer's claim for refund of the purchase price.

11. The Seller may withdraw from the purchase contract only before the goods are dispatched, if the goods are sold out or unavailable. The Seller will inform the Buyer without delay by e-mail and refund all money received, including delivery costs, without delay in the same way or in the way specified by the Buyer.

VII.

Liability for defects (complaints)

1. The Seller is liable to the Buyer that the goods have no defects when taken over. In particular, the Seller is liable that at the time of taking over

  • the goods have the agreed characteristics or, if not agreed, the characteristics described by the Seller or manufacturer or expected by the Buyer with regard to the nature of the goods and advertising,
  • the goods are fit for the purpose stated by the Seller or for which goods of this kind are usually used,
  • the goods are in the appropriate quantity, measure or weight, and
  • the goods comply with legal requirements.

2. The Buyer may claim a defect that appears in consumer goods within 24 months of taking them over.

3. If the period during which the goods can be used is stated on the goods, their packaging or in advertising, the provisions on quality guarantee apply.

4. The Buyer is not entitled to claims for defects for goods sold at a lower price for the defect for which the lower price was agreed, for wear caused by normal use, or if the Buyer knew about the defect before taking over the goods or caused it themselves.

5. If a defect occurs, the Buyer may file a complaint and request

  • replacement with new goods,
  • repair of the goods,
  • a reasonable discount on the purchase price,
  • withdrawal from the contract.

6. The Buyer has the right to withdraw from the contract if the goods have a material defect, if the goods cannot be used properly because of a recurring defect after repair, or if the goods have a larger number of defects.

7. When filing a complaint, the Buyer informs the Seller which right they have chosen.

8. The Seller will confirm in writing when the Buyer filed the complaint, what it concerns and how the Buyer wants it to be handled, as well as the date and method of handling it.

9. The Seller will respond to the complaint within 14 days of receipt at the latest. The complaint, including removal of the defect, will be handled without undue delay and no later than 30 days from the day it was filed, unless the Seller and the Buyer agree on a longer period. Complaints are sent to the Seller's e-mail address stated in these Terms.

10. In the case of a justified complaint, the Buyer is entitled to reimbursement of reasonably incurred costs connected with the complaint.

11. Liability for defects is governed by the Civil Code and Act No. 634/1992 Coll., on Consumer Protection. This does not affect the rights of consumers under the mandatory law of their country of residence.

VIII.

1. The parties may deliver all written correspondence to each other by e-mail.

2. The Buyer sends correspondence to the Seller's e-mail address stated in these Terms. The Seller sends correspondence to the e-mail address stated in the Buyer's customer account or order.

IX.

Personal data

1. All information the Buyer provides is confidential and will be treated as such. Without the Buyer's written consent, the Seller will use the Buyer's data only to perform the contract, except for the e-mail address to which commercial communications about similar or related goods may be sent, unless the Buyer refuses them. The Buyer may unsubscribe from these communications at any time (by letter, e-mail or by clicking the link in the communication).
